利用規約

この利用規約（以下「本規約」といいます）は、へべれけ小町（以下「運営者」といいます）が提供するスマートフォン用アプリケーション「UpcatMemo」（以下「本アプリ」といいます）の利用条件を定めるものです。本アプリを利用される皆様（以下「ユーザー」といいます）には、本規約に従って本アプリをご利用いただきます。

第1条（適用・Apple標準EULA）

1. 本規約は、ユーザーと運営者との間の本アプリの利用に関わる一切の関係に適用されるものとします。

2. 本規約に規定のない事項については、Apple Inc.が定める「Apple メディアサービス利用規約」および「標準エンドユーザー使用許諾契約（EULA）」が適用されるものとします。

第2条（医療に関する免責・サービス内容）

1. 本アプリは、猫の嘔吐を記録・可視化するためのツールですが、獣医療の診断・治療行為を提供するものではありません。

2. 本アプリのアラートや記録内容はあくまで参考情報であり、ペットの健康状態を保証・診断するものではありません。ペットの体調不良等は、必ず獣医師の診断を受けてください。

3. 運営者は、本アプリの利用により生じた、ペットの健康被害を含むいかなる損害についても一切の責任を負いません。

第3条（有料プラン）

本アプリでは、より便利な機能を利用できる有料プラン「UpcatMemo Plus+」を提供しています。アプリ内購入やApp Store上では、プラン名が「Premium」等と表示される場合があります。

1. プランと価格

• 月額プラン: ¥150 / 月（初回14日間無料トライアルあり）
• 年額プラン: ¥1,200 / 年（初回14日間無料トライアルあり）
• 買い切りプラン: ¥2,400（一括払い・将来の新機能も永続解放）

※価格は変更される場合があります。アプリ内の購入画面をご確認ください。

2. 無料トライアルについて

• 月額・年額プランは初回のみ14日間の無料トライアルが適用されます。
• トライアル期間終了の24時間前までに解約しない場合、有料プランに自動移行します。
• 同一Apple IDでのトライアルは一度のみ適用されます。

3. 課金について

• 購入のお支払いは、お客様のApple ID（iTunesアカウント）に請求されます。
• 買い切りプランは、一度のお支払いで永続的に有料機能をご利用いただけます。追加の請求は発生しません。

4. サブスクリプション（月額・年額）の自動更新について

• 月額・年額プランは「自動更新」となります。
• 登録期間終了の24時間前までに解約（自動更新をオフ）しない限り、プランは自動的に更新され、料金が請求されます。

5. 解約（自動更新の停止）方法

アプリの削除だけでは解約されません。以下の手順で解約を行ってください。

1. iPhoneの「設定」アプリを開く
2. 一番上の自分の名前をタップ
3. 「サブスクリプション」をタップ
4. 「UpcatMemo」を選択し、「サブスクリプションをキャンセルする」をタップ

※買い切りプランは解約の必要はありません。

6. ダウングレード時の扱い

• サブスク解約後も、現在の契約期間終了までプレミアム機能をご利用いただけます。
• 契約期間終了後、登録猫が4匹以上の場合は記録の閲覧のみ可能となり、新規追加は制限されます。

7. 機種変更時の復元

• 機種変更時には、以前購入した有料プランを無料で復元できます。アプリ内の「購入を復元」ボタンを押してください。

第4条（家族共有機能）

1. 家族共有機能はGoogle Firebaseが提供するCloud FirestoreおよびFirebase Authenticationを使用してデータを保存・同期します。

2. 通信環境やシステム状況により、データの同期遅延や不具合が発生する可能性があります。

3. 家族共有は「招待コード」を使用して行います。招待コードの管理はユーザーの責任において行うものとし、第三者への漏洩等により生じた損害について、運営者は責任を負いません。

4. ゲスト（招待を受けた側）はプレミアムプランの契約なしに家族共有機能を利用できます。

5. 共有機能を利用する場合、猫のプロフィール、猫アイコン画像、嘔吐記録、メモ、作成日時・更新日時等が共有相手に表示される場合があります。

第5条（データ管理と免責）

1. 本アプリに入力されたデータ（猫のプロフィール、嘔吐記録等）の管理およびバックアップは、ユーザーご自身の責任で行うものとします。共有機能はバックアップを保証するものではありません。

2. 機器の故障、通信障害、本アプリの不具合、またはユーザーの誤操作（アプリのアンインストール、機種変更時の引き継ぎ忘れ等）によりデータが消失・破損した場合について、運営者は一切の責任を負わず、データの復旧義務を負わないものとします。

第6条（禁止事項）

ユーザーは、本アプリの利用にあたり、以下の行為をしてはなりません。

1. 法令または公序良俗に違反する行為
2. 犯罪行為に関連する行為
3. 本アプリのサーバーまたはネットワークの機能を破壊したり、妨害したりする行為
4. 本アプリの不具合を意図的に利用する行為
5. 本アプリの課金システムを不正に回避・操作する行為
6. その他、運営者が不適切と判断する行為

第7条（利用規約の変更）

運営者は、必要と判断した場合には、ユーザーに通知することなくいつでも本規約を変更することができるものとします。なお、本規約の変更後、本アプリの利用を開始した場合には、当該ユーザーは変更後の規約に同意したものとみなします。

第8条（準拠法・裁判管轄）

本規約の解釈にあたっては、日本法を準拠法とします。本アプリに関して紛争が生じた場合には、東京地方裁判所を専属的合意管轄裁判所とします。

Terms of Use

These Terms of Use (hereinafter referred to as the "Terms") set forth the conditions for using the smartphone application "UpcatMemo" (hereinafter referred to as "this App") provided by Hebereke Komachi (hereinafter referred to as the "Operator"). All users (hereinafter referred to as "Users") must use this App in accordance with these Terms.

Article 1 (Applicability & Standard EULA)

1. These Terms shall apply to all relationships related to the use of this App between the User and the Operator.

2. For matters not stipulated in these Terms, the "Apple Media Services Terms and Conditions" and "Licensed Application End User License Agreement (EULA)" established by Apple Inc. shall apply.

Article 2 (Medical Disclaimer & Service Content)

1. This App is a tool for recording and visualizing cat vomiting, but it does not provide veterinary medical diagnosis or treatment.

2. The alerts and recorded content in this App are for reference purposes only and do not guarantee or diagnose the health status of pets. If your pet is unwell, please consult a veterinarian.

3. The Operator assumes no responsibility for any damages, including health damage to pets, caused by the use of this App.

Article 3 (Paid Plans)

This App offers a paid plan called "UpcatMemo Plus+" which allows access to more convenient features. In-app purchases or the App Store may display the plan name as "Premium" or similar.

1. Plans and Pricing

• Monthly Plan: ¥150 / month (with 14-day free trial)
• Yearly Plan: ¥1,200 / year (with 14-day free trial)
• Lifetime Plan: ¥2,400 (one-time, includes future features)

*Prices are subject to change. Please check the purchase screen within the app.

2. Free Trial

• Monthly and Yearly plans include a 14-day free trial for first-time subscribers.
• If not cancelled at least 24 hours before the end of the trial period, the plan will automatically convert to a paid subscription.
• The free trial is available only once per Apple ID.

3. Billing

• Payment will be charged to your Apple ID (iTunes Account) at confirmation of purchase.
• The Lifetime Plan allows unlimited access to paid features with a single payment. No additional charges will occur.

4. Automatic Renewal of Subscription (Monthly/Yearly)

• Monthly and Yearly plans renew automatically.
• Unless cancelled (auto-renew turned off) at least 24 hours before the end of the current period, the plan will automatically renew and you will be charged.

5. Cancellation (Turning off Auto-Renewal)

Deleting the app does not cancel the subscription. Please follow these steps to cancel:

1. Open the "Settings" app on your iPhone.
2. Tap your name at the top.
3. Tap "Subscriptions".
4. Select "UpcatMemo" and tap "Cancel Subscription".

*Cancellation is not required for the Lifetime Plan.

6. Downgrade Policy

• After cancelling a subscription, premium features remain available until the end of the current billing period.
• After the billing period ends, if more than 3 cats are registered, viewing existing records remains possible but adding new cats will be restricted.

7. Restore Purchases

• When changing devices, you can restore previously purchased paid plans for free. Please press the "Restore Purchases" button within the app.

Article 4 (Family Sharing Feature)

1. The Family Sharing feature uses Cloud Firestore and Firebase Authentication provided by Google Firebase to store and synchronize data.

2. Data synchronization delays or bugs may occur depending on the communication environment or system status.

3. Family Sharing is conducted using an "invitation code." Users are responsible for managing their invitation codes. The Operator assumes no responsibility for damages caused by leakage to third parties.

4. Guests (invited users) can use the Family Sharing feature without a premium plan subscription.

5. When using the sharing feature, cat profiles, cat icon images, vomit records, notes, creation dates, update dates, and related information may be shown to shared users.

Article 5 (Data Management and Disclaimer)

1. Users are responsible for managing and backing up data entered into this App (cat profiles, vomit records, etc.). The sharing feature does not guarantee backup.

2. The Operator assumes no responsibility and has no obligation to restore data in the event of data loss or corruption caused by device failure, communication errors, App malfunctions, or User actions.

Article 6 (Prohibited Acts)

Users must not engage in the following acts when using this App:

1. Acts that violate laws or public order and morals
2. Acts related to criminal activities
3. Acts that destroy or interfere with the functions of the App's server or network
4. Acts that intentionally exploit bugs in this App
5. Acts that fraudulently circumvent or manipulate the App's payment system
6. Other acts deemed inappropriate by the Operator

Article 7 (Changes to Terms)

The Operator may change these Terms at any time without notice to the User if deemed necessary. If the User starts using this App after the change of these Terms, the User is deemed to have agreed to the changed Terms.

Article 8 (Governing Law and Jurisdiction)

These Terms shall be interpreted in accordance with Japanese law. In the event of a dispute regarding this App, the Tokyo District Court shall be the exclusive agreement jurisdictional court.
